1. Consent and Grant of Rights: By replying with the hashtag #YESMitsubishiCAN, you grant Mitsubishi Motor Sales of Canada, Inc. (MMSCAN), its affiliated companies, successors, assigns, and their respective employees, contractors, agents, and representatives the right and permission to use your social media post ("Content"). This includes but is not limited to your name, social username, likeness, image, trademarks, and/or copyrighted materials related to the content. Users retain ownership of their original content, but not the reposted version.

2. Age and Legal Capacity: You confirm that you are 18 years of age or older and have the legal capacity to enter into this agreement. You also confirm that you are not under any contract or agreement that would prevent you from granting these rights to MMSCAN.

1. Rights Granted: You grant MMSCAN a royalty-free, non-exclusive, perpetual, worldwide right to use, copy, display, exhibit, perform, publish, distribute, reproduce, adapt, modify, edit, create derivative works, reuse, republish, redistribute, or otherwise make any use ("Use") of the Content for any lawful purpose. This includes but is not limited to advertising, marketing, and promotional materials, in any manner, form, format, or media now known or later developed, including the Internet, TV, radio, print, and other digital services.

2. Geographic Scope: The rights granted are applicable nationally within Canada.

1. No Compensation: You acknowledge that there is no compensation involved in this initiative for the use of the Content.

1. Waiver of Approval: You waive any right to inspect or approve the Content or its Use now or in the future. MMSCAN may choose, at its sole discretion, to use or not use the Content at any time.

2. Release and Indemnity: You agree to release, indemnify, and hold MMSCAN, its affiliates, officers, directors, agents, representatives, assigns, and/or licensees harmless from all claims, causes of action, damages, losses, and liabilities, including attorneys' fees, arising out of or in connection with the Use of the Content.
   
3. Representations and Warranties for your Content: You represent and warrant that your Content does not violate or infringe another person’s copyright, trademark or other intellectual property rights, or another person’s rights of privacy or personality.
   
4. Limitation of Liability: You agree to fully and forever release and discharge MMSCAN and its affiliates, licensees, owners, directors, officers, shareholders, employees, and agents, successors, and assigns from and against any and all claims, demands, damages, losses, costs, liabilities, deficiencies, causes of action, suits, proceedings, judgments, settlements, interest, awards, penalties, fines, or expenses of any kind whatsoever, which you or your heirs, representatives, executors, administrators, or any other person acting on your behalf or on behalf of your estate, may have by reason of:

a) MMSCAN’s exercise of any rights granted by you under these Terms; or

b) Claims based on violation of third-party rights, including but not limited to, infringement of any intellectual property rights such as copyright or trademark, or violation of any privacy or personality rights.

1. Governing Law: This agreement shall be governed by and construed in accordance with the laws of the province of Ontario and the federal laws of Canada applicable therein.

2. Severability: If any provision of this agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent permitted by law.

3. Entire Agreement: This agreement constitutes the entire agreement between the parties concerning the subject matter herein and supersedes all prior agreements and understandings, whether written or oral.
